Terms of Service
These terms govern the use of the "Pianium" service (the "Service") provided by Easpe Inc. (the "Company"). Please use the Service after agreeing to these terms.
Article 1 (Definitions)
The definitions of terms used in these terms are as follows.
- Service - Services operated by the Company and related services
 
- Website - Website where the content of the Service is posted
 
- Content - General term for text, sound, still images, videos, software programs, code, etc. provided on the Service (including posted information)
 
- User - All persons who use the Service
 
- Registered User - Persons who have completed user registration on the Website
 
- ID - Character string uniquely held by registered users for using the Service
 
- Password - Encryption uniquely set by registered users corresponding to the ID
 
- Posting - Act of registered users posting text, character strings, images, comments, etc.
 
- Posted Information - General term for information such as text, character strings, images, comments, etc. posted by registered users through posting
 
- Personal Information - General term for information that can identify individuals such as address, name, occupation, phone number, etc.
 
- Registration Information - General term for information registered by registered users on the Website (excluding posted information)
 
- Intellectual Property - Things created through human creative activities such as inventions, designs, new plant varieties, designs, works, etc. (including natural laws or phenomena that have been discovered or elucidated and have industrial applicability), trademarks, trade names, and other things that indicate goods or services used in business activities, and trade secrets and other technically or commercially useful information for business activities
 
- Intellectual Property Rights - Rights stipulated by laws and regulations regarding intellectual property or rights related to legally protected interests, such as patent rights, utility model rights, breeder's rights, design rights, copyrights, trademark rights, etc.
 
Article 2 (Agreement to These Terms)
- Users may use the Service after agreeing to these terms of use.
- When a user downloads the Service to a smartphone or other information terminal and completes the agreement procedure for these terms, a usage contract in accordance with the provisions of these terms shall be established between the user and the Company.
- If the user is a minor, please use the Service after obtaining the consent of a parent or other legal representative.
- If a minor user uses the Service by falsely claiming to have the consent of a legal representative when they do not, or by falsely claiming to be of age, or by using deception to make others believe they are a person with legal capacity, they cannot cancel any legal acts related to the Service.
- If a user who was a minor at the time of agreeing to these terms uses the Service after reaching adulthood, that user shall be deemed to have ratified all legal acts related to the Service.
Article 3 (Changes to Terms)
- The Company may revise the content of these terms at any time without obtaining the consent of users, and users shall accept this without objection.
- When the Company revises these terms, it will notify users of the content by the method specified by the Company.
- The effect of the revision of these terms shall take effect from the time the Company provides the notification in the preceding paragraph.
- Users shall be deemed to have agreed to the revised terms of use without objection when they use the Service after the revision of these terms.
Article 4 (Account Management)
- Users shall register and manage information registered for use (hereinafter referred to as "Registration Information," including email addresses, IDs, passwords, etc.) at their own discretion and responsibility. Users shall not allow third parties to use this information or lend, transfer, change names, sell, or otherwise dispose of it.
- If the Service is used based on registration information, the Company may treat it as if the person who performed the registration used it, and all results arising from such use and all responsibilities accompanying it shall belong to the person who performed the registration.
- If damage occurs to the Company or third parties due to unauthorized use of registration information, users shall compensate the Company and third parties for such damage.
- Management of registration information shall be performed by users at their own responsibility, and the Company shall not be responsible for any disadvantages or damages suffered by users due to inaccurate or false registration information.
- If it becomes clear that registration information has been stolen or is being used by third parties, users shall immediately notify the Company of this fact and follow the Company's instructions.
Article 5 (Handling of Personal Information)
Personal information and user information shall be handled appropriately in accordance with the "Privacy Policy" separately established by the Company.
Article 6 (Prohibited Acts)
In using the Service, the Company prohibits users (hereinafter "Users") from the following acts. If the Company determines that a user has violated prohibited matters, the Company may take measures it deems necessary, such as suspending use or deleting posts, and users shall agree to this without objection.
- Acts that infringe on the intellectual property rights of the Company or third parties
- Acts that damage the reputation or credit of the Company or third parties, or unfairly discriminate against or slander them
- Acts that infringe on the property of the Company or third parties, or acts that may infringe on such property
- Acts that cause economic damage to the Company or third parties
- Threatening acts against the Company or third parties
- Users posting the following information - Information that poses a risk of damage to the rights and property of third parties
- Information that is harmful to third parties or information that physically or psychologically hurts third parties
- Information that constitutes crimes, illegal acts, or dangerous acts, and information that instigates or assists such acts
- Information that is intended to be illegal, harmful, threatening, abusive, racially discriminatory, defamatory, insulting, harassing, inflammatory, or offensive, or that may produce such results
- Information that is contrary to facts or information that is known to be non-existent
- Information that users do not have the right to control
- Information that infringes on the intellectual property rights or other property rights of third parties, including copyrights, or information that infringes on public interests or individual rights
- Information such as images or documents that constitute obscenity, child pornography, or child abuse
- Information that violates laws such as the Medical Practitioners Act
- Other information that the Company deems inappropriate
 
- Acts of using computer viruses or harmful programs, or acts that induce such use
- Acts that place excessive stress on the infrastructure facilities for the Service
- Attacks on the servers, systems, or security of the Website
- Acts of attempting to access the Company's services by methods other than the interfaces provided by the Company
- Acts of one user obtaining multiple user IDs
- Other acts that the Company deems inappropriate
Article 7 (Content Handling)
- Users may use the content of the Service only within the scope determined by the Company.
- The Company owns all rights related to all content provided by the Service and does not grant users permission to implement or use the patent rights, utility model rights, design rights, trademark rights, copyrights, or other intellectual property rights owned by the Company.
- Users are prohibited from reproducing, transmitting, transferring (including sales between users), lending, translating, adapting, unauthorized reprinting, secondary use, commercial use, modification, reverse assembly, reverse compilation, reverse engineering, etc., by any method beyond the scope of use determined by the Company.
- Notwithstanding the preceding paragraph, if a user loses their user qualification due to withdrawal, etc., the right to use the provided content shall also be extinguished.
- Copyrights (including all copyrights including rights stipulated in Articles 21 to 28 of the Copyright Act) regarding content that users post or transmit by other methods on the Service (still images, videos, text information, and all other information) shall belong to the users. However, users grant the Company permission to use such content free of charge and non-exclusively in Japan and abroad at the time of transmitting the content.
- Users shall not exercise moral rights within the Service.
Article 7-2 (User-Generated Content)
- Users may post user-generated content (hereinafter referred to as "UGC") such as posts, comments, reactions, etc. on the Service.
- When posting UGC, users must agree to these terms of use and understand and agree that inappropriate audio, posts, comments, and other content and behavior are not tolerated.
- If users post inappropriate UGC, the Company may take measures such as deleting the UGC or suspending the account.
- Users shall take care not to cause inconvenience or damage to other users or third parties through posting UGC.
Article 8 (Disclaimer)
- The Company shall not be responsible for any damage caused by changes, suspension, or termination of the Service content.
- The Company shall not be involved in or responsible for the user's environment for using the Service.
- The Company makes no warranty that the Service will be suitable for the user's specific purposes, have the expected functions, commercial value, accuracy, or usefulness, that the user's use of the Service will comply with applicable laws or internal rules of industry organizations, or that no defects will occur.
- The Company does not guarantee that the Service will be compatible with all information terminals, and users shall acknowledge in advance that defects may occur in the Service operation due to OS version updates of information terminals used for the Service. The Company does not guarantee that such defects will be resolved by program corrections made by the Company.
- Users shall acknowledge in advance that the use of all or part of the Service may be restricted due to changes in operational policies.
- The Company shall not be liable for any damage that occurs directly or indirectly to users due to the use of the Service.
- The Company shall not be responsible for any damage (including indirect damage and lost profits) such as lost opportunities or business interruption that occurs to users or other third parties, even if the Company was notified in advance of the possibility of such damage.
- When there is a request for deletion of posts from other users or third parties, the Company may decide whether to delete them at its discretion, and the Company shall not be responsible for any responsibility arising from such decisions.
- The provisions of paragraphs 1 through the preceding paragraph shall not apply when the Company has intent or gross negligence, or when the contract falls under the consumer category under the Consumer Contract Act.
- Even when the preceding paragraph applies, the Company shall not be responsible for compensating damage caused to users by negligent acts (excluding gross negligence), especially damage arising from special circumstances.
- When the Company is liable for damages related to the use of the Service, the Company's liability for damages shall be limited to the amount of usage fees received from users in the month when the damage occurred.
- The Company shall not be responsible for disputes and troubles between users and other users. Even if users have trouble with other users, they shall resolve it between themselves and shall not make any claims to the Company.
- If users cause damage to other users or have disputes with third parties related to the use of the Service, they shall compensate for such damage or resolve such disputes at their own expense and responsibility, and shall not cause any trouble or damage to the Company.
- If the Company receives claims for damages from third parties due to user actions, users shall resolve this at their own expense (including attorney fees) and responsibility. If the Company pays damages to such third parties, users shall pay all costs (including attorney fees and lost profits) including such damages to the Company.
- If users cause damage to the Company related to the use of the Service, they shall compensate the Company for such damage at their own expense and responsibility (including litigation costs and attorney fees).
- The Company does not guarantee the accuracy of information posted by other users on the Service. The Company shall not be responsible for any disputes or troubles regarding information posted on the Service.
Article 9 (Advertisement Placement)
Users shall be deemed to understand and agree that various advertisements may be included on the Service, and that the Company or its partners may place various advertisements. The form and scope of advertisements on the Service may be changed by the Company from time to time.
Article 10 (Prohibition of Rights Transfer)
- Users shall not transfer all or part of their status under these terms or rights or obligations based on these terms to third parties without prior written consent from the Company.
- The Company may transfer all or part of the Service to third parties at its discretion, and in such cases, all user rights related to the Service, including user accounts, shall be transferred to the transferee within the scope of the transferred rights.
Article 11 (Severability)
Even if any provision or part of these terms is determined to be invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions of these terms and the remaining parts of provisions determined to be invalid or unenforceable shall continue to have full effect.
Article 12 (Contact Method with the Company)
User contact and inquiries to the Company regarding the Service shall be made by sending from the inquiry form placed in appropriate locations on the Service or the website operated by the Company, or by methods separately specified by the Company.
Article 13 (Governing Law, Jurisdiction)
- The validity, interpretation, and performance of these terms shall be governed by Japanese law and interpreted in accordance with Japanese law.
- All disputes, litigation, and other conflicts between the Company and users shall be subject to the exclusive jurisdiction of the Tokyo Summary Court or Tokyo District Court, depending on the amount of the claim.
